Property Division Basics

California is a community property state. Financial or property assets attained over the course of a marriage are subject to valuation and equitable distribution between spouses in the event of divorce. Equitable distribution does not mean, however, that everything is necessarily converted to a cash value and split 50-50. It means that all assets are on the table and the parties negotiate a property settlement. In the event the spouses cannot resolve a dispute about property and/or debt, the issue goes to trial, where a judge decides.

Community property law does not mean that separate assets and property owned independently by either spouse prior to the marriage automatically become community property. Separate property may remain classified as noncommunity, if the married couple does not commingle the assets to increase the value of the estate.
